Is it copy right infringment to merely load the picture on the computer through the browser? No disrespect to Kyle. I'm not sure where thing are going when it comes to IP(software patents are even more "effed up" than the copyrights) law in our country I think its a big old mess.

I really don't think hte RIAA and the MPAA are going about it the right way suing their customers. They need to figure out how to make the technology work for them and not against them.

As to photos I'm not sure what your actual recourse would be against someone using the images you posted here as a screensaver/desktop (unless they started to sell or use it as advertising). Some people might say by posting the picture here your giving an implicit permission for them to view it/use it (though not redistribute it).

If I set my desktop content to be "active-html" and basically have my background/screen saver serve/link images from your site(or dendroboard) am I breaking your copyright? How different is this from me caching the images on my machine and doing the same thing(though this would save bandwidth on your server)?

I think the only defacto way to really preserve you copyright (with regards to the above situation of a lone person using them as background/screen saver images) to the images, is to: not share them (no one wants that I hope), alter them in such a way as with a watermark in such a place that to own a "licensed" copy is much preferrable, or lastly to only share lower res versions which is similiar to the second option.

Personally I think option 3 is the best, along with only fairly open policy towards the personal/private use of those images. By all means if someone is using your pictures on the internet (or publically) w/o your permission or worse yet trying to sell them/profit off them, go after them.

I agree 100%, the thing that gets me on this one is the only people losing is the recond companies, as they rob the artist blind before any downloading would ever happen. I think apple and others have some great ideas, and it seems to bne starting to take off. I will tell you that if the RIAA and MPAA think that nabster and the others are the BIG fish they are nuts...

Thats a very interesting thought, but don't think it is as like you said I did post them. I agree many of our laws need major work due to the increase in technology. My worry is that they sometimes go way too far with some of the new laws.

The only issue I have really is the use without permission. Right click and save as is creating a copy. Now I do like you said and mark my photos and also keep the size small so a high quality print is not possible. There are digital watermarking options out there but they are still very expensive.

I love that people have an interest in my photos, as to me it is just a hobby that allows me to take greater interest in my frog hobby. I have been honored to have my pictures used by a couple zoos, and buisness, but I also would like to protect that right as much as possible so I can continue to do those things without someone else doing them as me. Its a very tricky subject.
