That first picture is an A+

The second picture is great but probably not something for the show room.

The third picture is very nice. I like that the frog is in focus and the background does not compete with the frog’s beauty (I like when backgrounds are not in focus for this very reason) however, the front right leg got caught in the transition, that's the only drawback.

I have viewed all the photos you have shared and they are absolutely beautiful. Keep sending them!! Have you thought about packaging and selling downloadable computer screensavers that would cycle through a few of your pictures for a fee?

Lol, I already have many many many of your pics already part of my screensaver!

I use the windows screensaver setting that pulls pics out of the "my pictures" folder... which I put my favorite pics in. Safe to say you are well represented in the folder

While I thank you for taking such an interest in my photos, you are violating my copyright, which is clearly stated on my website:

Kyle, I seriously hope your kidding about her breaking a copyright law. You need to relax. First off, this person is using the pic as a screensaver, Are u kidding me?

Not that I would use your work anyway but, AS LONG AS people are not using your photos to make money in anyway shape or form, people are allowed to do as they please. Thats at least how I thought it was.

Whatever I maybe wrong.

And yes you are wrong just like many were wrong with MP3s. Right click and save as is considered a copy or a reproduction. To be honest I would love to post some larger shots, but don't as they would be high enough quality to get a prints out of and people would abuse them. There are actually companies in other countries making money off other peoples work because there are now local laws to stop them. Its more of education than anything else, people think that just becuase it is on the net it can be used for anything. That is just not the case.

So if I was to sell a screensaver, how many do you think would even care based on what is already beeing done? See where I am going...

Is it copy right infringment to merely load the picture on the computer through the browser? No disrespect to Kyle. I'm not sure where thing are going when it comes to IP(software patents are even more "effed up" than the copyrights) law in our country I think its a big old mess.

I really don't think hte RIAA and the MPAA are going about it the right way suing their customers. They need to figure out how to make the technology work for them and not against them.

As to photos I'm not sure what your actual recourse would be against someone using the images you posted here as a screensaver/desktop (unless they started to sell or use it as advertising). Some people might say by posting the picture here your giving an implicit permission for them to view it/use it (though not redistribute it).

If I set my desktop content to be "active-html" and basically have my background/screen saver serve/link images from your site(or dendroboard) am I breaking your copyright? How different is this from me caching the images on my machine and doing the same thing(though this would save bandwidth on your server)?

I think the only defacto way to really preserve you copyright (with regards to the above situation of a lone person using them as background/screen saver images) to the images, is to: not share them (no one wants that I hope), alter them in such a way as with a watermark in such a place that to own a "licensed" copy is much preferrable, or lastly to only share lower res versions which is similiar to the second option.

Personally I think option 3 is the best, along with only fairly open policy towards the personal/private use of those images. By all means if someone is using your pictures on the internet (or publically) w/o your permission or worse yet trying to sell them/profit off them, go after them.

Good points Tad, let me see if I can guess at some of them, but again i'm not copyright a lawyer either. :-)

I agree 100%, the thing that gets me on this one is the only people losing is the recond companies, as they rob the artist blind before any downloading would ever happen. I think apple and others have some great ideas, and it seems to bne starting to take off. I will tell you that if the RIAA and MPAA think that nabster and the others are the BIG fish they are nuts...

Thats a very interesting thought, but don't think it is as like you said I did post them. I agree many of our laws need major work due to the increase in technology. My worry is that they sometimes go way too far with some of the new laws.

The only issue I have really is the use without permission. Right click and save as is creating a copy. Now I do like you said and mark my photos and also keep the size small so a high quality print is not possible. There are digital watermarking options out there but they are still very expensive.

I love that people have an interest in my photos, as to me it is just a hobby that allows me to take greater interest in my frog hobby. I have been honored to have my pictures used by a couple zoos, and buisness, but I also would like to protect that right as much as possible so I can continue to do those things without someone else doing them as me. Its a very tricky subject.

I think if someone wanted to do use his pictures like that wether selling them or not should ask for his permition. He clearly puts alot of effort into his photography and doesnt wnat anyone to just go off and act like its for anyone to use. I know there were no bad intentions here, but still gotta realise that he takes this serious and you should respect that wether it is copyrighted or not.

On a public forum like this, copyright law can seem like such a pain and totally counterintuitive. It is really frustrating that there are limitations on doing things that are as simple as copy-paste or right-click-as. Sometimes I even miss things. Thank you everyone for understanding. One picture or article isn't worth the hurt that someone, with a bug in their ass, can bring

Digital watermarking:
Never got to grips with this before but this discussion inspired me yesterday. Found this:
http://graphicssoft.about.com/cs/photos ... ermark.htm
Needs Photoshop, but then very easy to do.
BTW, love your photos Kyle.

Yes I do this in the bottom right of my photos, and rather not ruin the overall look by putting it in the center, What I was talking about is like this:
http://www.digimarc.com/

They have actually dropped the prices a good amount I may have to start using it...
